Rent Increase Notice Requirements

Standard 30-Day Notice

Most states require landlords to provide at least 30 days written notice before a rent increase takes effect for month-to-month tenancies. For fixed-term leases, rent generally cannot increase until the lease term ends.

States With Longer Notice Periods

California requires 90 days notice for increases over 10%. Oregon requires 90 days for any rent increase. New York requires 30–90 days depending on the tenant's length of tenancy. Always verify requirements with your local housing authority or an attorney.

Rent Control & Stabilization

Many cities — including New York City, Los Angeles, San Francisco, and others — have rent stabilization or rent control laws that limit how much and how often you can raise rent. These laws apply to specific types of buildings and tenancy types. Violating rent control can result in fines and penalties.

Best Practices for Landlords

Deliver notice in writing and keep a copy. Send via certified mail or email with read receipt for proof of delivery. Give adequate lead time so tenants can plan their budget. Reasonable, incremental increases reduce tenant turnover.
